Legal Nurse Consultant's Scope of Practice 
  • The LNC provides medical (consulting expert only) and nursing opinions as the expert on health, illness and injury and on the inner workings of the health care system.
  • The attorney is the expert on the legal issues and the law governing the case.
  • The LNC does not render legal advice.
  • The attorney serves as the advocate, the person who pleads and urges the cause of another. The testifying expert should NEVER advocate a position in the case.
  • The LNC does not speak for the client, but rather represents and speaks for the nursing profession. The client is not the focus, but may be the beneficiary of the LNC's involvement in the case.
  • The LNC provides education where needed.
  • The LNC's services are utilized by Attorney's, Insurance Companies, Health Care Facilities, other LNC's and medical-legal consultants, Governmental agencies and private corporations.
The LNC's Impact of the Legal System 
  • LNC's represent and speak for the nursing profession.
  • LNC's uphold Standards of Care for the health care community by identifying meritorious cases and communicating deviations from recognized standards resulting in improved quality of care.
  • LNC's identify fraudulent and non-meritorious claims, and help to defend against them or keep them out of the system.
  • LNC's help to assure that the legal system uses scientific, medical and nursing information properly and without distortion.
  • LNC's provide a cost-effective adjunct to the litigation process.

Attorney Services Provided 
  • Screen or investigate medical malpractice case for merit.
  • Define the applicable Standards of Care.
  • Define deviations from and adherence to applicable Standards of Care.
  • Assess alleged damages/injuries.
  • Identify factors that cause or contribute to alleged damages/injuries.
  • Organize, tab and paginate medical records.
  • Summarize, translate and interpret medical records.
  • Identify and recommend potential defendants.
  • Identify and review relevant medial records, hospital policies and procedures, other essential documents and tangible items.
  • Consult with health care providers.
  • Identify types of testifying experts needed.
  • Locate and interface with expert witnesses.
  • Prepare interrogatories.
  • Review and draft responses to legal documents/correspondence.
  • Assist with preparation of deposition or trial examination questions.
  • Review, analyze and summarize depositions, including past testimony.
  • Attend depositions, trials, review panels and arbitration/mediation hearings.
  • Develop written reports for use as study tools by the attorney.
